Foreign conspiracy and force majeure are words that will remain in the history of Telangana. Are these going to become the most expensive words in history? People of Telangana should especially know about “Force Majeure”. But the analysts say that the CM does not mean that there is a foreign conspiracy behind the floods unlike what he openly says. Now the same discussion is going on in Telangana. What is the hidden agenda behind these words? Let us know the reasons behind the CM’s comments.
Force majeure means that if there is a loss in the work done by the contractor due to any reason, the matter of whether the contractor should bear the loss or the department that has done the work will be decided according to this “force majeure” clause. If the contractor is found to be solely responsible for the damage, the contractor will have to bear all the damage at his own expense. If it is found that the loss is due to other reasons, then the entire loss will be borne by the government and the contractor has nothing to do with the damage.
Events beyond the contractor’s control are called force majeure events. Severe floods, earthquakes, storms, acts of terrorism, wars, etc. come under force majeure events. However, if there is any damage to the structures undertaken by the contractor, the matter of who is responsible for the damage has to be decided first. This is very important. This will decide whether the burden is on the contractor or on the public.
Medigadda and Annaram pump houses built as part of the Kaleswaram project were submerged in the recent floods. It was reported that the Medigadda pump house sank due to the collapse of the concrete wall and the Annaram pump house got submerged due to flood water. The preliminary estimate is that hundreds of crores of rupees have been lost. And who bears this loss? Contractor?Government? This matter will be decided on the basis of the “Force Majeure” clause.
If the concrete wall of the Medigadda pump house collapses due to flood water, due to poor quality, it is the contractor’s fault! Also, if the flood is predicted below the design standards, the level of the pump house is wrongly decided, and the pump house is not taken due to these reasons, it is the fault of the contractor. The contractor shall be fully responsible for the damage caused. Apart from that, if the wall of the Medigadda pump house collapses due to flooding beyond the design level even if there are no quality defects or design defects, then the contractor is not responsible. The government should bear the loss.
Before knowing what this matter was, it was labeled a “foreign conspiracy” and it was concluded as an “unprecedented flood disaster”, leaving the government without the task of setting up a committee to resolve it. This means that the word “foreign conspiracy” has now become the most expensive word in history. While there is a serious discussion about “foreign conspiracy” in the state, the contractor on the other hand is excited, with redoubled enthusiasm, and is ready to take over giant projects worth hundreds of crores of public money. Shouldn’t it be considered a conspiracy by the government? Or should we think that the government is not aware of the actual cloud burst?
