BREAKING: Kokapet’s Real Estate group wars continue…

Telangana state’s real estate industry has no dearth of controversies day in and day out! As days are passing by more and more real estate related scams, irregularities, group fights and skirmishes are being witnessed across different places of the state.

The long list includes the issues between Green Build Developers vs. KBR Society, where in the general public feels that there might have been certain big shots behind the scenes and there are issues like the nala conversion / mutation in addition to prompting litigation thanks to official revenue records! In addition, good number of issues pertaining to the border areas of different site locations across the state is emerging slowly but steadily. The tremendous pressure on officials and the other concerned stakeholders is for sure a cause of concern for all the parties concerned.

Toli Velugu’s Exclusive Crime bureau brings out the story on the much sought after Kokapet lands! Kokapet…requires no introduction, in real estate business terms it’s a ‘Goldmine!’   Yes…Kokapet’s real estate business is worth of thousands of crores of rupees! It is estimated that someone having even a cent of land here may have the chance to become crorepathi…imagine the scenario; if there was a disputed land, then what a great boon for the politicians! As the days are passing by the demand for the prime properties is increasing and so are the disputes, litigation, group fights etc., and at times some of them ending up as street fights as well. Even, Police were facing lot of pressure to handle situation in an amicable and peaceful way. There are allegations that BRS MLA from far off Bhupalapalli is having a strong control on the current real estate situation at Kokapet. It was alleged that based on the assurance of Minister from Mahabubnagar quoting court judgment, the real estate war was started off in Kokapet affecting Kokapet’s law & order situation. In spite of these obstacles and pressures, Toli Velugu’s crime bureau team has conducted an investigation on this land. The one question doing rounds is that why BRS party is encouraging such disputes. On enquiry with ex-police officer and also about the number of complaints at the police station paved the way for details on the dispute of the private property land and related issues.

Let’s move on to the intricate details of land buying & selling:

Mukkala Veerayya of Kokapet is the original holder of Pattadar Passbook having land as per survey numbers 154, 155 and 156 consisting of 21 acres and 26 ‘guntas’. In 1964, Veerayya has sold 9.26 acres of this land to Karan Singh Mamoli Bai. This land is situated at the extreme western side. In 1967, this land was taken by B Radhakrishna, Kakarla Kamala Devi and V Rama Devi. In 1969, Radha Krishna made 6 plots out of 30 ‘guntas’ of this land and sold them out. In 1998, another part of this land, about 7.12 acres was sold to KBR family. In 2016, part of the land admeasuring about 2.14 acres was transferred in the names his sons Madhusudhan Rao & Ajay Kumar. Again in 2016, the same land of 2.14 acres was sold to Venkateswara Reddy. Though Radhakrishna originally owns 8.13 acres of land he has sold 10.13 acres of land, by registering 2 acres of land in survey number 154 without having those 2 acres of land on his name and started claiming from year 2003. In 1968, another plot of about 4.25 acres of land in the eastern side was purchased by M A Khayeem and in the year 1979, this land was taken by Mallikarjuna Rao. In 2004, this land was purchased by T Ajay Reddy and others and they went on to build Lumbini Villas. The five legal heirs of Veerayya sold the land in between eastern side and western side admeasuring to 7.15 acres. 4 acres was sold to G Rajendra and 2.29 acres was sold to Madhavi Latha. In 2005, Rajendra sold to Komatireddy Anil Reddy and others. Madhavi Latha has sold to T Giridhar Reddy and Padmaja.

Dispute started with DHARANI:

The land sold to Radhakrishna in 1982 has gone in for mutation as in 1993, Jagadeeswar Appa, Eswar Lal and Sivaji have appealed to the RDO with the Agreement Sale on Registrar document stating that the land sold to Radhakrishna was already sold to them earlier. Jagadeeswar, being patwaree submitted all the proceedings and got in to the revenue records. Subsequently, the RDO has dismissed the petition submitted by Jagadeeswar and others. In 1997-98, the issue has gone in to the attention of Joint Collector and was rejected. In 2002, a writ petition was submitted on JC’s order. In 2014, the order issued by JC was dismissed and orders were issued for a fresh enquiry on the issue. The High Court has issued judgment stating that the status quo has to be maintained.

However, in 1998 itself, the Krishnaveni Bhim Reddy Educational Society (KBR) has got the conversion of agricultural land in to nala conversion for commercial purposes. In 2015, the contention of the persons who have submitted that they have purchased the land from the heirs of Veerayya was struck by the Joint Collector by saying that this entire land was under the revenue court and maintained in the prohibited list. However, on checking the revenue records, it was found out to be the same which listed earlier. On finding the same information in DHARANI also, the legal heirs of Sivaji have gone in to agreement with Green Build Developers. With this Agreement, a suit was filed in Ranga Reddy court (180 of 2022). Sivaji’s heirs have not attended the court and as such the court has given ex-parte judgment. Both parties have stated that they would compromise and within 45 days, the registration would be completed in Lok Adalat and got the judgment to that effect. However, the deed was not executed within 45 days. As it was found to be under prohibited list, DHARANI officials haven’t proceeded further to register. As such, again an executive petition was submitted. In this the heirs of Sivaji were not present. As per ex-parte judgment and also as per the new rule in DHARANI, the official representing the court can go ahead with the registration.

However, without taking any of these above in to cognizance, the registration process was completed for the land of 5 acres and 14 ‘guntas’ as per the civil court judgment. A report was submitted to the court in this regard. At this stage, along with KBR society’s Ex DIG Gopinath Reddy’s brothers Gajamohan Reddy and Somasekhar Reddy, Lavanya is fighting for the possession. A complaint was lodged with the police. In the meantime, Bhimreddygari Mohan Reddy and Hanmanth Reddy of Green Build Developers from Rayalaseema are claiming that they are in possession of the title for the property. There are already judgments in the civil courts on the original title holders. Now with the ex-parte judgments coupled with DHARANI issues, the controversies have reached their peak.  At certain times, the situations have gone out of control and ended up as street fights as well.

POLITICAL COLOURING…

The EIPAL real estate company is located opposite this land. The BRS party’s MLA is relative of this builder. KBR society is alleging that the MLA may be getting the support of the Minister from Mahabubnagar and may try to take possession of the property. At the same time, Sridhar Reddy, Owner of EIPAL denies of having any relationship with Green Build Developers. It is alleged that the entire sketch for the midnight clashes and disturbances was planned from his office only. All said and done the Kokapet SEZ is engulfed with all kinds of real estate related clashes, disputes and related disturbances, which were unheard of in recent times and as things stand it appears to be a very sorry state of affairs with uncalled for controversies erupting every now and then.
