Indu Malhotra to become a Judge in the Supreme Court

Senior Lawyer Indu Malhotra will soon be appointed as a Judge of the Supreme Court. The Law Ministry has approved the recommendation of the Supreme Court collegium in this regard. However, the promotion of Uttarakhand Chief Justice K.M.Joseph to the Supreme Court has been put on hold.
 

 
Indu Malhotra, who is an Arbitration expert will soon take oath as a Judge of the Supreme Court. Of the 24 justices presently serving in the Supreme Court, only one – R. Bhanumati, appointed in August 2014 – is a lady. Indu Malhotra will become the second female justice of the Supreme Court. A five member committee headed by Chief Justice Deepak Mishra recommended the names of Indu Malhotra and K.M. Joseph for appointment 14 weeks back.
 
 
While Ms. Malhotra’s appointment is confirmed, Justice K.M.Joseph’s promotion has become controversial. In 2016, the Justice had delivered a judgement against the imposition of President’s rule in Uttarakhand, which paved the way for Harish Rawat to come back to power. A month after this judgment, the collegium had recommended his transfer to the Andhra Pradesh and Telangana High Court. However, this was not implemented due to the Centre’s silence on the matter. Now, his promotion too has been affected. Eyebrows are rising over approval of one of the two names recommended, and the rejection of another. The Chief Justice has been approached to intervene in this issue.
