Dismissing the curative plea petition filed by Pawan Gupta, one of the convicts in the gangrape and murder case of Nirbhaya, the Supreme Court also passed orders related to the organ donation of the victims. The Apex Court also dismissed a petition seeking the donation of the organ by four convicts. While a former judge MF Saldana asked the court to permit the Tihar jail authorities to give the option for the convicts to donate their organs.
The plea also urged the court to allow the convicts to donate their bodies to medical research. The petitioner asked to consider the “desirability of making it as a condition precedent in the case of all executions”. However, dismissed the petition stating that the donation should be voluntary. “Have some human approach. You want their bodies cut before execution?” asked the Apex court. In the line of this verdict, the four convicts will have an option to donate their bodies and organs post the execution.
