Rules, regulations, and legal litigations..nothing will fall in the way of the lands under the eyes of Phoenix. The construction company seem to turn powerful than the government authorities as the documents irrespective of the titles became ultimatums. In case of the officials turns against the company, it was learned to obtain a favorable verdict in a snap despite the respective land in years-long litigations.
All permits for lands will be granted with even hearing the defendants’ version. These permits in turn are like weapons to turn all the officials in favour of the company. However, things changed and the Phoenix gang took a step back with the victims coming out filing a slew of cases in the court. The saga of withdrawing cases started.
This is about Inam lands located in Mamidipalli village in Balapur mandal which are not yet mutated by the government. There is a land dispute going on over these 42 acres. The land being empty and close to airport T. Prakash Gowd, a politician, attempted to clear ten acres of land in Survey No. 41 in 2002 and failed. The land ultimately went into the hands of Patel Engineers, a renowned Mumbai company.
Being a disputed land, Phoenix take over from them for their real estate venture. Th purchase was made on July 5th with document number 366/2019. Balapur Tahsildar mutated the land with File No.MUT / 05/03/00019/2020 Dated: 11-02-2020 in the name of Phoenix within six months. It was during the COVID times that the company kicked up the 30-year-old controversy without any arguments.
With the help of the same mutations, approvals were taken in HMDA on January 4 this year. 10 acres 12 guntas in Survey No.41, 3 acres 15 juntas in 42,43, 14 acres in 56,57,58, 7 acres 9 juntas in Survey No. 60, 8 acres 6 pits in Survey Nos. were acquired.
A writ petition has been filed in the High Court against these lands. The court received the petition of the respondents with WP NO 14838/2020, 14840,14841,14842 / 2020. Mir Fayaz Ali Khan and Abdul bin Mohammed who moved the court appealed that F1 / 883/2019 dated 20/06/2020 issued by the Additional Collector, J / 2201/2018 dated 11/03/2019 orders issued by RDO were issued under political influence.
While they argued that the arbitrator had infringed the Compensation Act and inflicted damages under Articles 14, 19, 21 and 300A, Justice Shameem Akhtar accepted the petition and issued notices to Phoenix and Patel Engineers who claimed the land.
Another file number is F1 / 884/2019 dated 20-06-2020, RDO Orders No. J / 1790/2018 dated 11 03 2019 were also stated to be issued under political pressures. While the land lord’s case is still pending in court, the HMDA permission was granted by RERA in January and in March. It was learned that the company has withdrawn the cases out of fear of losing on the legal front.
